By purchasing, subscribing to, accessing or using a paid ToffeeGames service, you agree to these Terms of Service.

1. The Service

ToffeeGames is a Discord-based reseller toolkit that may include monitoring, alerts, sourcing tools, calculators, reseller utilities, data, information and related features.

Tools, platforms, monitoring intervals, limits and features may change as the service develops.

Current features and operational information may be shown in our Discord server or other official ToffeeGames channels.

2. Subscription

Paid services are recurring subscriptions at the price and billing interval shown at checkout.

Subscriptions renew automatically until cancelled.

Payments use the provider available at purchase.

Applicable charges are shown before you pay.

3. Discord Access and Paid Access

Access to the ToffeeGames Discord server itself is free and does not require a paid subscription.

A paid subscription is required to access the ToffeeGames Monitors and any other features, tools, channels or services designated as paid within the Discord server.

Paid access may be assigned manually or automatically.

For manual access, you may need to provide enough information to match your payment to your Discord account.

Unless stated otherwise, each subscription covers one person and one Discord account.

You must not share, transfer, sell, rent or otherwise give paid access to anyone else.

4. Monitoring and Alerts

Monitoring helps identify potentially relevant listings, products, stock changes and sourcing opportunities.

Monitoring frequency and alert speed may vary with:

• the third-party platform being monitored

• the type of search

• system demand

• technical conditions

• third-party restrictions

• infrastructure performance

• changes made by external platforms

Published monitoring intervals and alert speeds are estimates, not guarantees.

5. No Guarantee of Results

ToffeeGames does not guarantee that:

• every relevant listing, product or stock change will be detected

• every alert will arrive immediately

• alerts will arrive before another user or competing service identifies an opportunity

• an item will still be available when an alert is received

• third-party information will always be complete, accurate or current

• a seller will complete a transaction

• an item will be genuine or as described

• use of the service will result in a purchase, sale or profit

You are responsible for your own purchasing, selling and sourcing decisions.

6. Third-Party Services

ToffeeGames may rely on external websites, platforms, APIs, software, hosting, proxies, payment processors, Discord and internet infrastructure.

Third-party changes, outages, restrictions, rate limits, blocking, maintenance or technical issues may reduce or prevent service operation.

We do not control these services or guarantee their availability, performance or compatibility.

A third-party service failure may not affect other parts of ToffeeGames.

7. Service Changes

We may add, remove, replace, modify, update or improve features as the service develops.

This may include changes to:

• supported platforms

• monitoring systems

• alert formats

• monitoring intervals

• search limits

• commands

• tools

• calculators

• infrastructure

• access methods

• payment providers

• subscription structures

Where appropriate, we will give reasonable notice of significant changes that materially affect an active paid subscription.

Minor improvements, fixes, infrastructure changes and operational adjustments may happen without notice.

8. Maintenance and Downtime

The service may be unavailable or reduced due to:

• scheduled or emergency maintenance

• updates

• software faults

• hosting problems

• server issues

• proxy or network problems

• third-party outages

• changes to external websites or platforms

• circumstances outside ToffeeGames’ reasonable control

We will make reasonable efforts to restore affected services.

Temporary downtime or reduced functionality does not automatically entitle you to a refund. Statutory consumer rights are unaffected.

9. User Equipment and Internet Connection

You are responsible for suitable equipment, software, internet access and Discord access where required.

We are not responsible for access problems caused by your own:

• internet connection

• mobile network

• computer

• mobile device

• operating system

• browser

• Discord application

• Discord account

• local network

You are responsible for internet, mobile data, roaming and other usage charges.

10. Account Security

Keep your Discord account, login details and devices secure.

Do not let others use your paid access.

Notify ToffeeGames as soon as reasonably possible if you believe your account is compromised.

We may temporarily suspend access if we reasonably suspect account sharing, unauthorised access or suspicious activity.

11. Acceptable Use

Users must not:

• share, transfer or resell paid access

• bypass or attempt to bypass account limits or usage restrictions

• deliberately overload or disrupt the service

• interfere with ToffeeGames infrastructure

• attempt to gain unauthorised access to restricted systems or administrative features

• scrape, copy or reproduce substantial parts of the service without permission

• reverse engineer the service

• attempt to extract source code

• circumvent technical protections

• use the service for unlawful or fraudulent activity

• use ToffeeGames systems in a way that could damage the service or other users

Serious or repeated breaches may result in suspension or termination.

12. Intellectual Property

Unless stated otherwise, intellectual property connected with ToffeeGames belongs to ToffeeGames or the relevant rights holder.

This may include:

• software

• source code

• monitoring systems

• bots

• commands

• databases

• alert systems

• layouts

• graphics

• branding

• logos

• documentation

• written material

• custom tools

• service functionality

A subscription permits personal use of the paid service while your subscription is active.

It does not transfer intellectual property ownership.

Without written permission, you must not copy, modify, reproduce, distribute, sell, license, reverse engineer or create derivative versions of the service, except where this restriction would be unlawful.

13. Cancellation

You may cancel using the cancellation method available at the time.

Unless the law requires otherwise, cancellation stops future renewals. Access normally continues until your paid period ends.

You are responsible for cancelling subscriptions you no longer want.

Statutory cancellation rights are unaffected.

14. Refunds

Refund requests are considered under applicable consumer law.

Refunds are not normally provided solely because:

• a particular listing was missed

• another service alerted first

• an item sold before the user was able to purchase it

• the user chose not to use the service

• the user did not make a profit

• the user’s internet, device or Discord access failed

• a third-party platform was temporarily unavailable

• normal temporary maintenance occurred

These Terms do not remove or restrict statutory consumer rights.

15. Pricing

Subscription prices may change.

Where required, we will notify active subscribers before charging a changed price.

Where required, you can cancel before a new recurring price takes effect.

Promotional prices, discounts and offers may be introduced or withdrawn.

16. User Responsibility

Independently check relevant information before buying or selling.

Where relevant, check:

• item condition

• authenticity

• seller reliability

• selling prices

• purchase prices

• platform fees

• postage

• travel costs

• taxes

• profit margins

• demand

• return policies

• marketplace rules

Calculators, estimates, prices and sourcing information are guidance only.

Do not rely solely on ToffeeGames for financial or purchasing decisions.

17. Liability

ToffeeGames provides monitoring, sourcing and reseller-support tools.

To the extent permitted by law, we are not responsible for losses arising from:

• purchasing an item

• selling an item

• failing to purchase an item

• travelling to collect an item

• relying on third-party information

• missed alerts

• delayed alerts

• inaccurate listings

• fraudulent sellers

• changes in resale value

• failed transactions

These Terms do not exclude or limit liability where doing so would be unlawful.

18. Suspension and Termination of User Access

We may suspend or terminate paid access if we reasonably believe you have:

• seriously or repeatedly breached these Terms

• shared or resold access

• attempted to interfere with the service

• used the service fraudulently or unlawfully

• created a security risk

• attempted to access restricted systems

Where appropriate, we may give a warning before termination.

Serious misconduct may lead to immediate suspension or termination.

19. Discontinuing the Service

We may discontinue all or part of the service.

Where reasonably practicable, we will give active subscribers appropriate notice of material discontinuation.

If a paid service permanently ends during your paid period, refunds, credits or other remedies will depend on applicable law and the circumstances.

Statutory consumer rights are unaffected.

20. Privacy and Personal Data

We may process personal information as needed to provide services, manage subscriptions, offer support, maintain security and run the community.

Personal information will be handled in accordance with the ToffeeGames Privacy Policy and applicable data-protection requirements.

Payment providers may process payment information under their own privacy policies and terms.

21. Changes to These Terms

We may update these Terms to reflect:

• changes to the service

• changes to business operations

• legal or regulatory requirements

• security requirements

• new features

• changes to third-party services

The latest Terms will be available through an official ToffeeGames location.

Where appropriate, we will give reasonable notice of changes that materially affect active paid subscribers.

Subject to applicable law, continued use after updated Terms take effect may constitute acceptance.

22. Support, Feedback and Complaints

Get support, share feedback or report problems in the relevant Discord channels or through another official contact method we provide.

Provide enough detail for us to investigate technical problems.

23. Governing Law

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that apply to you.

Rights that cannot legally be excluded or restricted are unaffected.
